What this website collects, what it deliberately does not, and exactly where a form submission goes. There is no database behind this site — every form you fill out is emailed straight to Kyle.

The short version

No accounts, no logins, no database. Nothing you type into this site is stored on it.
Forms are emailed, not saved. Your browser hands the submission to a form-to-email service, which relays it to Kyle's inbox.
Analytics are cookieless and aggregate. We can see that a page was opened from Tucson on an iPhone. We cannot see who you are, and we cannot follow you to another website.
Nothing is sold, rented, or traded. Not to lead brokers, not to lenders, not to anyone.
You can ask what Kyle has, and ask him to delete it. Email or call — the details are at the bottom of this page.

The rest of this page is the long version, including the parts that are less flattering: hosting providers keep server logs, embedded third-party content sees your IP address, and once you become a client, Arizona law requires the brokerage to keep transaction records for five years whether you want it to or not.

Who this policy covers

This policy covers https://www.kyleberglund.com and the forms on it. The site is operated by Kyle Berglund, a licensed Arizona REALTOR® (license #SA668710000) affiliated with Tierra Antigua Realty.

Tierra Antigua Realty is a separate company. Once you sign a listing agreement, a buyer-broker agreement, or a purchase contract, that paperwork is handled through the brokerage and is subject to the brokerage's own privacy practices and record-keeping obligations, not this page. Ask Kyle for the brokerage's policy and he will get it to you.

Information you choose to give us

Everything this site learns about you personally comes from a form you decided to fill out. There is no tracking pixel quietly building a profile in the background, and no field is collected that isn't visible on the form in front of you.

Contact form: Name, email, phone (optional), what you're interested in, and your message.
Home valuation request: Name, email, phone, the property address you want valued, and details you volunteer about the home — beds, baths, square footage, condition, timeline.
Land valuation request: Name, email, phone, the parcel or address, and any zoning, acreage, or utility details you provide.
Custom home search: Name, email, phone, and your search criteria — price range, areas, must-haves, timeline, financing status.
Site-wide popup: Name, email, and phone. Closing the popup instead sends nothing at all.

Please don't send Social Security numbers, bank account or routing numbers, full dates of birth, or images of financial statements through any web form or by ordinary email — not here and not to any other agent. When a transaction genuinely needs that information, it goes through your lender's or the title company's secure portal, never a website contact box.

What actually happens to a form submission

Your browser sends the form contents directly to a third-party form-to-email provider — currently a service in the Formspree / Web3Forms category. The data does not pass through a server we run, because there isn't one.
That provider emails the submission to Kyle.
The message then lives where any email lives: in Kyle's mailbox, and in his email provider's systems, until it is deleted.
No copy is written to this website. There is no admin panel, no CRM sync, and no export to a lead marketplace.

The form provider necessarily sees whatever you typed, plus the technical details of the request (IP address, browser) that any web request carries, and applies its own retention schedule and spam filtering. If you want to know which provider is in use on the day you're reading this, ask — Kyle will tell you and point you at their privacy policy.

Information collected automatically

Hosting logs: The site is hosted on Vercel. Like every web host, Vercel records requests — IP address, user agent, the URL requested, and a timestamp — for delivery, security, and abuse prevention, on Vercel's own retention schedule.
Vercel Web Analytics: Cookieless. Visitors are counted using a hash derived from the incoming request that resets every 24 hours, so a visitor cannot be tracked from one day to the next or from this site to any other. The data points are the event timestamp, the URL, the referrer, filtered query parameters, coarse geolocation, device type, operating system, and browser.
Vercel Speed Insights: Anonymous page-performance measurements — Core Web Vitals such as how quickly the largest element painted. It does not reconstruct a browsing session or identify a visitor.

What Kyle sees from all of this is a chart: how many people read a neighborhood page last week, roughly where they were, and whether the page loaded quickly. He cannot click through to a person, because the data doesn't contain one.

Cookies and browser storage

This site sets no cookies of its own. There are no advertising pixels, no remarketing tags, no Facebook or TikTok conversion trackers, and no cross-site identifiers — which is also why you have never seen a cookie banner here.

Two values are written to your browser's sessionStorage, which your browser discards when you close the tab:

lead_popup_dismissed: Set when you close the lead-capture popup, so it stops reappearing for the rest of that visit. Without it, the popup would be a nuisance rather than an offer.
A one-time reload flag: Set if a page's JavaScript chunk fails to load — usually because a new version of the site deployed while your tab was open. It allows exactly one automatic reload, so a stale tab recovers instead of looping.

Neither is an identifier, neither is sent anywhere, and both vanish when the tab closes. Clearing site data in your browser removes them immediately.

Third-party content that loads on this site

A handful of things on these pages are served by other companies. Any request your browser makes to them reveals your IP address and browser to that company, and their privacy policies — not this one — govern what they do with it.

The embedded dashboard is the one place where a third party runs code inside a page here. It is sandboxed, it is on the Market Stats page only, and the same numbers are published as plain text and as a downloadable CSV for anyone who would rather not load it.

How your information is used

To answer you. Almost every submission exists because someone asked a question, and the use is the reply.
To do the work you asked for — run MLS searches against your criteria, prepare a comparative market analysis for your address, pull parcel and zoning records for a lot.
To keep in touch about your search or sale while it's active, and to send market updates if you asked for them.
To meet Arizona real estate law and brokerage supervision requirements once you are a client.

Your information is not used to build advertising audiences, is not uploaded to ad platforms as a custom audience, and is not used to train anyone's model.

Your information is never sold, rented, or traded — including to the lead-generation companies that routinely buy real estate inquiries. It is shared only in these situations:

At your direction. If you ask for an introduction to a lender, title officer, inspector, contractor, or another agent, Kyle passes along what's needed for that introduction and nothing more.
With the brokerage. Arizona requires a designated broker to supervise transactions and keep records, so transaction files are visible to Tierra Antigua Realty.
In a transaction. Offers, counteroffers, and disclosures reach the other side of the deal, their agent, escrow, and the lenders involved — that is what making an offer is.
When a listing goes live. Property information you provide for a listing becomes public through the MLS of Southern Arizona and every site that syndicates from it.
When the law requires it. Regulators such as the Arizona Department of Real Estate, or a subpoena, court order, or other lawful legal process.

Calls, texts, and email

Giving Kyle your phone number on a form is how you consent to being contacted at it, including by text message, about the real estate question you asked. Consent is not a condition of buying or selling anything, message and data rates may apply, and message frequency depends entirely on what's happening in your search.

Reply STOP to any text to end texts, or just say so on the phone or by email. There is no drip campaign to escape and no unsubscribe maze — one message ends it, and an opt-out is honored regardless of which channel you use to ask.

How long things are kept

Inquiry emails: Kept while the conversation is live and for as long as it is useful to your search. Ask and they're deleted.
Transaction records: Arizona law requires the employing broker to keep records of each transaction for at least five years after the transaction ends, and to keep documentation of rejected offers for at least one year (A.R.S. § 32-2151.01). Those are the brokerage's legal obligations and a deletion request cannot override them.
Analytics: Aggregate figures only, with no personal data in them to delete.
Hosting logs: Short-lived, on the hosting provider's own schedule.

Your choices, and how to exercise them

Ask what Kyle has about you, and he will tell you.
Ask him to correct something that's wrong.
Ask him to delete it — subject only to the record-keeping obligations above.
Ask to stop hearing from him, by any channel or all of them.
Use your browser's Do Not Track or Global Privacy Control setting; see below.

Arizona has no comprehensive consumer privacy statute, and a solo REALTOR® falls well under the thresholds of the California, Colorado, and Virginia laws — but requests are honored regardless of where you live, because the alternative is refusing a reasonable request on a technicality. Kyle may ask a question or two to confirm you are who you say you are before acting on a request about someone's personal information.

Security — and one warning worth reading twice

The site is served only over HTTPS, with HSTS, a strict content security policy, and no stored visitor data to breach in the first place. That last part is the strongest security property on this list: a database that doesn't exist cannot leak.

The real risk in a real estate transaction is not this website — it is wire fraud. Criminals monitor email around closings, then send convincing instructions to redirect a down payment or closing funds, sometimes from an address that looks nearly identical to a real one.

So: Kyle will never email you wiring instructions, and neither will a legitimate escrow officer without you initiating it. Before sending money, call the title or escrow company at a number you looked up yourself — not one from the email — and confirm every digit of the account with a human. If wiring instructions change at the last minute, treat it as fraud until proven otherwise. This kind of loss is usually unrecoverable.

Children

This site is meant for adults doing adult things — buying, selling, and researching property. It is not directed to children under 13 and does not knowingly collect their information. If you believe a child sent something through a form here, email Kyle and it will be deleted.

Do Not Track, Global Privacy Control, and AI crawlers

This site publishes a Do Not Track policy in the EFF's format. Practically speaking, there are no advertising or cross-site trackers here to switch off, which is why a DNT or GPC signal changes so little about what happens on these pages.

This site also publishes how it expects AI systems to use its content, and it welcomes AI crawlers reading the public pages — that is a decision about published articles and market data, not about you. Nothing you send through a form is part of it.

Changes to this policy

If this policy changes in a way that matters, the date at the top of the page changes with it. Continuing to use the site after that means the current version applies. Nothing here is applied retroactively to information you already sent under an earlier version.
