What this website is, and is not

This is a marketing and education site for a Tucson real estate practice. It explains neighborhoods, market conditions, buying and selling processes, and how Kyle works.

  • It is not an MLS or an IDX listing feed. Homes described here are illustrative, and any property discussed may already be under contract or sold.
  • It is not an offer to buy or sell real estate, and nothing here creates a binding obligation on anyone.
  • It is not legal, tax, accounting, engineering, appraisal, or lending advice. Those all require professionals holding those licenses, and Kyle isn't one of them.

Reading this site does not make you a client

In Arizona, a real estate agency relationship is created by a written agreement — a listing agreement, a buyer-broker agreement, or similar — not by browsing a website, downloading a guide, or sending a message. Until something is signed, Kyle owes you honesty and fair dealing, but not the duties he owes a client, and he may be representing other buyers or sellers competing for the same property.

One practical consequence: information you send through this site is not confidential in the legal sense a client's information is. Don't send anything you would not want the other side of a negotiation to know before you have representation in writing.

Accuracy — deemed reliable, not guaranteed

Market figures, neighborhood averages, school notes, and community details are compiled from sources believed reliable — including MLS of Southern Arizona statistics, the Zillow Home Value Index, Redfin market reports, and public records from Pima County and the municipalities. They are not guaranteed, and neighborhood and subdivision averages in particular are rounded, long-run estimates rather than a current market report.

Verify anything you plan to act on. That means square footage, lot lines and easements, zoning and permitted use, flood zone and floodplain status, septic versus sewer, well and water rights, HOA rules and dues, school attendance boundaries, permit history, and taxes. Independent inspections, surveys, appraisals, and a title report exist precisely because a website cannot substitute for them.

The calculators produce estimates, nothing more

The mortgage, affordability, cost-of-waiting, and solar calculators are educational models. Each publishes its assumptions on its own page, and each is only as good as the numbers you feed it.

  • A payment estimate is not a loan offer, a rate quote, a pre-approval, or a commitment to lend. Only a lender can tell you what you qualify for.
  • An affordability figure is arithmetic on the inputs you typed, not an assessment of your finances.
  • A valuation estimate is not an appraisal and not a comparative market analysis.
  • Solar output and payback figures are models, not a bid, and not tax advice. Get written quotes and talk to a CPA.

AI-assisted content and AI-generated images

This site is open about how it is made. Editorial copy is drafted with AI assistance and reviewed for accuracy before publication, and the site-wide disclosure in the footer says so on every page.

The photographic and scenery imagery is AI-generated and illustrative. It does not depict specific real properties, real people, or exact real places, and every such image carries an "AI-Generated" label. The exceptions are labeled as real because they are: the headshot and family photo of Kyle, and brand logos such as Tierra Antigua Realty and Equal Housing Opportunity.

What you send us

Please make sure what you submit is accurate — a valuation built on wrong square footage is wrong, and an offer built on wrong information is worse. Don't send confidential material belonging to someone else, and don't send sensitive financial identifiers through a web form.

Reviews and testimonials are published only with the reviewer's permission, and normally as a first name and last initial with a city. Ask and yours will be removed or anonymized. How submissions are handled technically is covered in the privacy policy.

Fair housing and accessibility

Every property discussed on this site is offered without regard to race, color, religion, sex, national origin, familial status, or disability, and Kyle's own policy goes further than the law requires. The site is also built to be usable with a keyboard and a screen reader, and there is a route for reporting anything that isn't.

Copyright complaints

If you believe something here infringes your copyright — a photograph, a passage, a data compilation — say so and it will be reviewed promptly and removed if the claim holds up. Send notice to Kyle Berglund at the email or address at the bottom of this page.

To act on a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512), it needs to include: your signature (electronic is fine); identification of the work you say was infringed; the URL of the material you want removed; your contact details; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for them.

If your material was removed and you believe that was a mistake, send a counter-notice with the same contact details and a statement under penalty of perjury explaining why. Accounts and contributors who repeatedly infringe are cut off.

Wire fraud warning

Kyle will never send you wiring instructions by email, and neither will a legitimate escrow officer out of the blue. Before wiring any money in a transaction, call the title or escrow company at a number you looked up independently and confirm the account details with a person you know. Treat last-minute changes to wiring instructions as fraud until proven otherwise — funds sent to a criminal account are usually gone for good.

Disclaimer of warranties

Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. Disputes about this website belong in the state or federal courts serving Pima County, Arizona.

If a provision here is unenforceable, the rest still stands. Not enforcing a term once doesn't waive it. These terms govern your use of the website only — they do not replace, modify, or override a signed listing agreement, buyer-broker agreement, purchase contract, or any other document you and Kyle actually sign, and where a signed agreement conflicts with this page, the signed agreement wins.

Licensing and regulatory information

These terms can change; the date at the top of the page tracks the last substantive revision, and using the site afterward means the current version applies.
